Terms of Service
When using Kunthea Imaging, you agree to the following terms and conditions (the "Terms of Service"). You can always check out the most current version of these Terms of Service at this page. In addition, when using particular Kunthea Imaging services, you shall be subject to any posted guidelines applicable to such services. All such rules and guidelines are hereby incorporated by reference into the Terms of Service. If you do not agree to these Terms of Service please do not use the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Service at any time. Please check these terms periodically for changes. Your continued use of the Kunthea Imaging Service following the posting of changes to these terms will mean you accept those changes.

Overview
Kunthea Imaging is a service, which allows you to use or access, services, including e-mail, search services, and broad range of other content (collectively the "Kunthea Imaging"). These Terms of Service apply to the Kunthea Imaging Service as well as any new products or services that we may add in the future (unless stated otherwise).

General Terms of Service and Restrictions on Use of Materials
By using the Kunthea Imaging Service, you agree to be legally bound and to abide by the Terms of Service, just as if you had signed this Agreement. If you do not comply with the Terms of Service at any time, Kunthea Imaging reserves the right to terminate your access the Kunthea Imaging Service. Kunthea Imaging may discontinue or alter any aspect of the Kunthea Imaging Service, including, but not limited to, (i) restricting the time the Kunthea Imaging Service is available, (ii) restricting the amount of use permitted, and (iii) restricting or terminating any user's right to use the Kunthea Imaging Service, at Kunthea Imaging's sole discretion and without prior notice or liability. You are responsible for all charges associated with connecting to the Kunthea Imaging Service through an available access number. You are also responsible for obtaining or providing all access lines, telephone and computer equipment (including modem), or other device, necessary to access the Kunthea Imaging Services You further certify that you are an individual. In order to permit Kunthea Imaging to protect the quality of its services, you hereby consent to Kunthea Imaging employees being able to access your account and records on a case-by-case basis to investigate complaints or other allegations or abuse.

You acknowledge that the Kunthea Imaging Service contains information (collectively, "Content") that are protected by copyrights, patents, trademarks, trade secrets or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or here after developed. All Content is copyrighted as a collective work under the US copyright laws, and Kunthea Imaging owns a copyright in the selection, coordination, arrangement and enhancement of such Content. The Kunthea Imaging name and logo are exclusively licensed to the Kunthea Imaging. All other trademarks appearing on the Kunthea Imaging Service are trademarks of their respective owners. Kunthea Imaging's partners may also have additional proprietary rights in the content, which they make available through the Kunthea Imaging service. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the Content, in whole or in part, except that you may download one copy of the materials on any single computer for your personal, noncommercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose, including use of any such material on any other web site or networked computer environment is strictly prohibited. In the event you download software provided by Kunthea Imaging, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by Kunthea Imaging. Kunthea Imaging does not transfer title to the Software to you. You may not redistribute, sell, decompose, reverse engineer, disassemble, or otherwise reduce the Software to a human-readable form. You agreed by signing or using Kunthea Imaging Service (workmanship, "graphics, and photos") that you bear no rights to any workmanship that are created by Kunthea Imaging (unless you distributed the material, "graphics, logo and texts").

Registration
If you elect to register to use the Kunthea Imaging Service and, or other services offered by Kunthea Imaging you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Kunthea Imaging Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it accurate. If you provide any information that is untrue, inaccurate, or incomplete, or Kunthea Imaging have reasonable grounds to suspect that such is the case, Kunthea Imaging has the right to suspend or terminate your account and refuse any and all current or future use of the Kunthea Imaging Service (or any portion thereof).

1. Usage. Kunthea Imaging - Web Designing services and systems shall be used by Customer for lawful purposes only. Customer shall not at any time: (a) transmit any content or material which violates any federal, state or local laws, regulations or ordinances; (b) transmit any content or material which is threatening, obscene, offensive or violates trade secret or intellectual property rights; (c) violate "etiquette" by, for example spamming, sending unsolicited mass e-mailings which provoke complaints from recipients, harassing or threatening others on the Internet or impersonating another user or otherwise falsifying one's true user name; or (d) otherwise violate these Terms and Conditions. Kunthea Imaging - Web Designing shall have no duty to monitor or censor content or material used by Customer. However, if Kunthea Imaging in its sole discretion determines that any content or material or other use of Customer's account violates these Terms and Conditions, Kunthea Imaging shall have the right, at its sole discretion, to remove such content or material from its system and/or suspend or terminate the provision of services to Customer. All content and material utilized in Customer's Web Page or Web Site, if any, shall be the property of Customer and not Kunthea Imaging. Customer agrees not to introduce any virus onto the Internet or Kunthea Imaging Systems. Customer understands that Kunthea Imaging does not own or control many of the various facilities, telecommunication lines, computing resources and other equipment utilized to provide Internet access and other services. The customer may pay for the maintenance fee on a monthly base, if forfeited the site will be terminated within 15 days until fees are paid in full. When using networks, computing resources and other facilities and equipment of other organizations, Customer must comply with all applicable rules, terms, conditions and policies of such organizations.

2. No Warranties. Kunthea Imaging provides all of its services, equipment, and software to Customer on an AS IS and AS AVAILABLE BASIS, and KUNTHEA IMAGING - WEB DESIGNING MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, all of which warranties are expressly disclaimed by Kunthea Imaging - Web Designing except to the extent that such warranties may not be disclaimed under applicable law, with regard to Kunthea Imaging - Web Designing services, equipment, and/or software including start-up CD. No oral advice or written information provided by Kunthea Imaging - Web Designing shall constitute a warranty. Customer agrees that its use of Kunthea Imaging - Web Designing services, equipment, and software is at Customer's own risk and that Kunthea Imaging - Web Designing shall not be responsible for damages of any kind including without limitation damages resulting from delay, interruption of service, data loss, or the use or inability to use Kunthea Imaging - Web Designing services. Customer is responsible for independent backup of Customers' data stored on Kunthea Imaging - Web Designing.

3. Payment. Customer agrees to the fees, billing procedures and payment schedule set forth herein. All fees are subject to change by Kunthea Imaging - Web Designing upon not less than thirty (30) day's notice to Customer in writing or by E-Mail transmission. Each month the billing cycle for all accounts shall be the anniversary date the account was established. A late payment charge, equal to 5% per month on the unpaid portion of any payment, will be charged on all payments not paid in full within fifteen (15) days of the due date. Suspended: if payment is not received with 10 to 15 days the site will be suspended. Customer is responsible for payment of all local and/or long distance telephone charges for connecting to the Internet using Kunthea Imaging - Web Designing. A service fee of $30.00 will be applied to all checks returned for Non Sufficient Funds (NSF).

4. Internet Information. Kunthea Imaging - Web Designing exercises no control over the content of information accessible on the Internet. Customer understands that some information accessible on the Internet may be offensive or, in certain instances, obscene. Reliance on, exposure to, or use of any information obtained via Kunthea Imaging - Web Designing is at Customer's own risk and Kunthea Imaging - Web Designing specifically denies any and all responsibility for the accuracy or quality of information obtained on the Internet.

5. Intellectual Property. Customer is solely responsible for the protection of any copyright, trademark or other intellectual property right which Customer may have or claim in any of Customer's material or content utilized in Customer's Web Page or Web Site, if any, or otherwise. Customer warrants that it has the right to any and all copyrights, trademarks or intellectual property used on or in connection with it's Web Page or Web Site and grants Kunthea Imaging - Web Design the right to display such in connection with its obligations under this agreement. Each party warrants that it has the right to use and display the software and data used in connection with its respective obligations under this agreement.

6. Liability. Customer agrees that Kunthea Imaging - Web Design Corporation shall not be liable for any direct, indirect, incidental, consequential or other damages resulting in any way from Customer's use of, or inability to use, Kunthea Imaging - Web Design services, equipment, and/or software. Customer agrees to indemnify and hold harmless Kunthea Imaging - Web Design, its affiliates and agents, from and against any and all claims, liabilities, damages, and expenses, including attorney's fees, resulting or alleged to result in any way from (a) Customer's use of , or inability to use, any services provided by Kunthea Imaging - Web Design, (b) Customer's use of, or inability to use, equipment or software, and/or (c) Customer's violation of these Terms and Conditions.

7. Security and Confidentiality Issues. Customer understands that Kunthea Imaging - Web Design is unable to prevent others from invading or breaking into Customer's physical network or other systems, and Customer agrees that Kunthea Imaging - Web Design shall not be liable in any way to Customer for any such invasion or break in. The provisions of this paragraph and otherwise herein continue to control in instances where Kunthea Imaging - Web Design has installed a "firewall" for Customer. In this context, a "firewall" is a configuration of hardware and software implemented to regulate the security of data transmission between one or more proprietary networks and the Internet. Customer understands that any such "firewall" provides no guarantee against invasion or break in. Customer is solely responsible for all use of Customer's account(s) and confidentiality of all passwords. E-Mail and other transmission transmitted over the Internet are, in many cases, not secure, and Kunthea Imaging - Web Design cannot guarantee the protection or privacy of any information. Customer understands that private and confidential information should not be placed onto the Internet.

8. Cancellation. Customer may terminate its account by providing notice of cancellation to Kunthea Imaging - Web Design Corporation by telephone, in writing or by E-Mail transmission. Upon the delinquency of Customer's account or violation (in the sole opinion of Kunthea Imaging - Web Design ) of any of these Terms and Conditions by Customer, Kunthea Imaging - Web Design may suspend or terminate (without prior notice) provision of services to Customer. Cancellation by Kunthea Imaging - Web Design or Customer, and/or Customer's failure to use services, shall not relieve Customer's obligations hereunder including with limitation payment of any fees and late payment charges due and payable.

9. Miscellaneous. Usage by the Customer of Kunthea Imaging - Web Design services shall constitute the customer's acceptance with the Terms and Conditions. Kunthea Imaging - Web Design reserves the right to modify these Terms and Conditions upon not less than thirty (30) day's notice to Customer in writing, by E-Mail transmission or notice posted on Kunthea Imaging - Web Design Web Site.Kunthea Imaging - Web Design Corporation.net Usage by Customer of Kunthea Imaging - Web Design services after such thirty (30) day notice period shall constitute Customer's acceptance of the modified Terms and Conditions. Kunthea Imaging - Web Design reserves the right to change, upon reasonable notice, access or dial-in procedures, hours of operation, commands, and other aspects of its services. Non-enforcement of any provision herein does not constitute consent, and Kunthea Imaging - Web Design reserves the right to enforce these Terms and Conditions at its sole discretion. Customer's account with Kunthea Imaging - Web Design is not transferable without Kunthea Imaging - Web Design consent. These Terms and Conditions reflect the entire agreement of the parties and supersede all prior oral or written agreements of the parties. These terms and conditions shall be governed by and construed in accordance with the laws of the State of Illinois.

10. Business card and Magnetic Sign: Product policy -- any product that is physically handle by contractors or designers must be UPS or US Post mark to clients. Before production can commence the client must review the material and if there are any typos or corrections the client will be responsible for submitting a revision. A demo of the revised material will be sent via email to client and the client will review the material again before sending the full agreed payment for production. The full agreed payment for production must be sent by mail or client have the option to pay online with paypal. If there are any errors on the product after clients agreed to the revised material and after receiving product and the client needed to request a reproduction, the client must pay the full agreed cost.

Kunthea Imaging's Privacy Policy
Pursuant to Kunthea Imaging's privacy policy, we may disclose to third parties certain information contained in your Registration Data or related data unless you choose to opt out from such disclosures or in the good faith belief that such action is reasonably necessary to comply with the law, legal process, or to enforce the Terms of Service.

Submissions
By posting or submitting content to this site, you grant Kunthea Imaging and its affiliates and licensees the right to use, reproduce, display, perform, post your business information for customer to review (the information you provided), adapt, modify, distribute, have distributed, and promote the content in any form, anywhere and for any purpose; and warrant and represent that you own or otherwise control all of the rights to the content and that public posting and use of your content by Kunthea Imaging will not infringe or violate the rights of any third party.
If you send us creative suggestions, ideas, notes, drawings, or other information (collectively, the "Submissions"), the Submissions shall be deemed, and shall remain, the property of Kunthea Imaging. None of the Submissions shall be subject to any obligation of confidence on the part of Kunthea Imaging, and Kunthea Imaging shall not be liable for any use or disclosure of any Submissions. Without limitation of the foregoing, Kunthea Imaging shall exclusively own all now known or hereafter existing rights to the Submissions of every kind and nature throughout the universe and shall be entitled to unrestricted use of the Submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Submissions.

The Kunthea Imaging Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Kunthea Imaging has no control over such sites and resources, you acknowledge and agree that Kunthea Imaging is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Kunthea Imaging shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

DISCLAIMER
Kunthea Imaging uses diligent efforts to maintain the Kunthea Imaging Service, but Kunthea Imaging is not responsible for any defects or failures associated with the Kunthea Imaging Service or any damages (such as lost profits or other consequential damages) that may result from any such defects, suspended site or failures. In addition, Kunthea Imaging makes no guarantees as to the sites and information located worldwide throughout the Internet to which you may access as a result of the use of the Kunthea Imaging Service, including as to: (i) the accuracy, currency, content, or quality of any such sites and information, or (ii) whether any search using the Kunthea Imaging Service may locate unintended and objectionable content.

THE KUNTHEA IMAGING SERVICE IS PROVIDED 'AS IS' AND YOU USE IT AT YOUR SOLE RISK KUNTHEA IMAGING EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
WITHOUT LIMITATION, KUNTHEA IMAGING MAKES NO WARRANTY THAT THE KUNTHEA IMAGING SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE RESULTS OBTAINED FROM THE USE OF THE KUNTHEA SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE KUNTHEA SERVICE WILL MEET YOUR EXPECTATIONS.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE KUNTHEA SERVICE IS DONE AT YOUR SOLE RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

The Kunthea Imaging Service allows you to obtain information on companies. The Kunthea Imaging Service, including all such business information, is provided for informational purposes only, and no information you may obtain is intended by Kunthea Imaging to be used for trading or investing purposes. Kunthea Imaging shall not be responsible for the accuracy, usefulness or availability of any information transmitted via the Kunthea Imaging Service, and shall not be liable for any trading or investment decisions made based on such information. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS Kunthea Imaging., THEIR PARENTS, AFFILIATES AND SUBSIDIARY COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS FROM ANY AND ALL THIRD PARTY CLAIMS, LIABILITY, DAMAGES AND/OR COSTS (INCLUDING, BUT NOT LIMITED TO, ATTORNEYS FEES) ARISING FROM YOUR USE OF OUR SERVICES, YOUR VIOLATION OF THE TERMS OF SERVICE OR YOUR INFRINGEMENT, OR INFRINGEMENT BY ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY. YOU AGREE TO IMMEDIATELY NOTIFY KUNTHEA IMAGING OF ANY UNAUTHORIZED USE OF YOUR ACCOUNT OR ANY OTHER BREACH OF SECURITY KNOWN TO YOU.

Termination and modification
You agree that Kunthea Imaging, in its sole discretion, may terminate your password,account (or any part thereof) or use of the Kunthea Imaging Service due to your delinquent account, and remove and discard any Content within the Kunthea Imaging Service, for any reason, including, without limitation, for lack of use or if Kunthea Imaging believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Kunthea Imaging may also in its sole discretion and at any time discontinue providing the Kunthea Imaging service, or any part thereof, with or without notice. Maintenance fees do NOT include web Hosting fees for your web site, which are subject to change. You agree that any termination of your access to the Kunthea Imaging service under any provision of this Terms of Service may be effected without prior notice,and acknowledge and agree that Kunthea Imaging may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Kunthea Imaging service. Breach agreement signed or verbal which comes first Kunthea Imaging act accordingly to any provision. Further, you agree that Kunthea Imaging shall not be liable to you or any third-party for any termination of your access to the Kunthea Imaging Service.

Kunthea Imaging has the right to refuse to service any existing or future clients due to false representation, rudeness or any other non-professional language, behavior or jester to any Kunthea Imaging staff through email, phone or in person. Kunthea Imaging bear the rights to discontinue service to clients that are consistently misunderstanding the agreement.
